Temporary Residence Permit in Ukraine Without a D Visa: Rules for Volunteers

A foreign volunteer agrees to join a project in Ukraine, checks the residence rules, and finds older instructions saying that the next step is to obtain a Type D visa abroad before applying for a temporary residence permit. Since July 1, 2026, that sequence no longer applies to every volunteer. Ukrainian law introduced a D visa exemption for specified categories of foreign volunteers. The exemption removes one prerequisite for the residence permit, but it does not create visa-free entry, extend a person's permitted stay, or replace the documents confirming volunteer activity.

The practical question is therefore not simply whether you are a volunteer, but whether your citizenship, host organization, documents, and current immigration status fit the exemption.

The D Visa Exemption for Foreign Volunteers

Law of Ukraine No. 4816-IX took effect on July 1, 2026. For the categories covered by the law, the usual requirement to hold a long-term Type D visa before obtaining a temporary residence permit no longer applies. The rule operates during martial law in Ukraine and for one year after martial law is terminated or canceled.

This change concerns the residence-permit process. It should not be confused with three separate issues: permission to cross the Ukrainian border, the period during which a foreign national may lawfully stay in Ukraine after entry, and the temporary residence permit itself. A person may be exempt from the D visa requirement for a TRP and still need a visa or another entry authorization under the rules applicable to their nationality.

The exemption therefore removes one stage. It does not create a new immigration status and does not allow a volunteer to remain in Ukraine indefinitely without filing for residence.

Eligibility for the Volunteer D Visa Exemption

The exemption covers foreign nationals and stateless persons who come to Ukraine to participate in international or regional volunteer programs, or to take part in the activities of organizations or institutions that engage volunteers under Ukrainian volunteer legislation.

Citizens of the Russian Federation are expressly excluded from this exemption. For other applicants, eligibility still depends on the actual residence ground and the documents supporting it. A person does not qualify simply because they describe their activity as volunteering or assist a charitable initiative informally.

Where the residence ground is cooperation with a host organization, check whether information about that organization is published on the National Social Service of Ukraine website as an organization or institution that engages volunteers, including foreign volunteers. This is part of the legal basis used for the residence application; it is not a personal 'accreditation' of the volunteer.

Before planning the application, confirm four points together: the applicant's citizenship, the type of volunteer activity, the legal status of the host organization or program, and the applicant's current immigration status in Ukraine. If any of these does not match the statutory route, the absence of a D visa will not by itself solve the problem.

Applying from Your Current Situation

The next step depends on where you are and how you are allowed to enter or stay in Ukraine. The D visa exemption does not make every applicant's route identical.

Your Situation and the Next Step

Your situation

What to do next

You are abroad and can enter Ukraine visa-free

Coordinate the host documents before travel, confirm that the exemption applies, and plan the filing date. Visa-free entry is not itself a residence ground.

You are abroad and need a visa to enter Ukraine

The D visa exemption for the TRP does not abolish all entry-visa requirements. Check the entry rules for your nationality and the actual purpose of travel.

You are already lawfully in Ukraine

Check the volunteer basis, host-organization documents, and the remaining period of permitted stay. Eligible applicants can file without leaving Ukraine if the conditions of point 32-1 of Resolution No. 322 are met.

For a volunteer who is already lawfully in Ukraine, point 32-1 of Cabinet of Ministers Resolution No. 322 is particularly important. It allows eligible foreigners who are not required by law or treaty to obtain a long-term visa for the residence permit to file without leaving Ukraine, provided they meet the filing deadline. The 2026 volunteer exemption can therefore remove the need for an artificial exit solely to obtain a D visa, but only when the applicant fits the exemption and remains within the lawful period for filing.

Documents from the Volunteer and the Host Organization

The Volunteer's Application Documents

The general application package includes a valid passport document and the required copies, a properly certified Ukrainian translation of the passport page containing personal data, medical insurance valid for the period of the residence permit, and proof of payment of the administrative fee or a document confirming an exemption from payment. A Ukrainian tax identification number is provided if the applicant has one.

For a volunteer who qualifies for the 2026 exemption, the Type D visa should not be treated as an unconditional document in the package. The first task is to verify that the applicant falls within the statutory exemption and is applying from a lawful immigration position.

Documents Confirming the Volunteer Basis

The documents proving the volunteer basis depend on how the activity is organized. For participation in the relevant international or regional program, the residence application relies on a submission from the competent state body responsible for the program. For the more common host-organization route, the file includes the host organization's submission and its state-registration document; the organization must also be one whose information is published by the National Social Service.

An invitation and a formal submission should not be treated as interchangeable terms. An invitation may describe the planned participation and may be used during preparatory stages, but the residence-permit rules identify the submission from the competent body or host organization as the document supporting the TRP ground.

If you want the complete residence-permit package reviewed before filing, our

Application Timing and Personal Attendance

Two separate 15-working-day periods matter. First, documents for an initial temporary residence permit must be filed no later than 15 working days before the end of the applicant's permitted stay in Ukraine. Second, the State Migration Service states that the permit is issued within 15 working days from the date the documents are accepted.

These are statutory processing and filing rules, not a promise that the entire matter can be completed in 15 working days from the first consultation. Time may be needed before filing to check the host organization, prepare its submission, translate the passport, arrange insurance, and correct inconsistencies.

Preparation can be coordinated remotely, including document review and communication with the host organization. The application itself is different: an applicant aged 16 or older generally submits the application form in person. The volunteer exemption does not turn the TRP procedure into a fully remote process that can be completed under an ordinary power of attorney.

Overstays and the Separate Transitional Rule

The 2026 law also created a separate one-time transitional mechanism for certain volunteers and humanitarian workers who had entered Ukraine after February 24, 2022. Those covered by the provision could be treated as lawfully staying in Ukraine if they applied for a temporary residence permit within 60 days after the new law took effect.

That transitional window is different from the continuing D visa exemption. By late October 2026, the one-time 60-day period has already expired, and it does not restart after each new entry. A person who has overstayed should therefore not assume that the absence of a D visa requirement automatically regularizes the overstay.

If your permitted stay has already expired, the immigration status must be assessed separately before a residence application is planned. The correct next step depends on the dates, the legal basis of stay, and any migration violations already recorded.

Common Mistakes When Using the Exemption

The most common problems arise when the applicant treats the exemption as broader than it is. Before filing, check the residence ground rather than relying on the label 'volunteer'; confirm that the host organization is properly reflected on the National Social Service website; make sure the organization prepares the correct submission; and compare names, passport details, and dates across all documents.

Timing is equally important. A volunteer who is already in Ukraine must preserve lawful stay long enough to meet the filing deadline. The exemption from a D visa does not guarantee issuance of the permit and does not cure an expired period of stay.

After the permit is issued, a later move to another host organization requires its own legal review. Our article on
changing your volunteer organization in Ukraine explains that next-stage issue without duplicating it here.

Legal Support for Your Volunteer Residence Application

Legal Service Ukraine can review the applicant's citizenship, entry date, current period of lawful stay, and volunteer basis before documents are filed. We can also verify the host organization, check whether the D visa exemption applies, prepare and review the application package, coordinate the host organization's documents, and support the filing with the State Migration Service.

This is particularly useful when the volunteer is already in Ukraine and the remaining period of lawful stay affects the filing strategy, or when older online instructions still describe the pre-July 2026 route.
