How to buy land in Ukraine?

The first question you need to answer is whether you are legally entitled to purchase. But let's say you can legally purchase the land you want. Here are a few simple rules and nuances that you need to consider:

  • Any property needs to be checked. In many cases, there are errors in documents. Therefore, you need to check both the plot of land itself - whether it is under arrest or in controversial situations. This is verified both through documents and by surveys and searching for land in different registries. Sometimes this is easier to do, for example, if we are talking about commercial real estate, sometimes it is more difficult.

  • You need to check not only the land, but also the owner. Often you will meet with a realtor first. You need to find out who exactly will sign the sales documents. Does this person have the full right to sell the land. If land ownership is held by multiple people, this can greatly complicate the situation.

  • It is important to draw up a sales agreement correctly. A series of negotiations with the seller may be necessary.

  • For a foreigner, it will be necessary to obtain a TIN in Ukraine and prepare translations of the passport. If you have problems understanding the Ukrainian language, you will need to invite a translator to the notary. We will provide all these points.

  • A deal is always carried out using Ukrainian currency. Ideally, via bank transfer.

  • After completing the purchase, you will need to enter information into the state register.

Can a foreigner buy agricultural land in Ukraine?

In 2021, after the law reform, the land market in Ukraine began operating. Most likely, over time, this would lead to the lifting of the moratorium on the sale of land to foreigners. But, unfortunately, due to military operations in the country, the moratorium is still ongoing. Foreigners today cannot directly buy agricultural land in Ukraine. There are, however, a few exceptions to the situation:

  • You can inherit such land. But you must carry out the alienation procedure within a year;

  • You can rent and use categories like farm land.

Previously, schemes for purchasing land in the name of companies registered in Ukraine, where, for example, one participant was a foreigner and the second was a Ukrainian citizen, were popular. But now there are restrictions on the citizenship of the beneficiaries of such companies.
